Terms and Conditions of Service
Wycliffe Charities Foundation, Inc., a not-for-profit corporation organized and existing under
the laws of the State of Florida (the “Foundation”), has undertaken through this website (the
“Undertaking”) to organize and facilitate volunteer activities (“Activities”) for members of
Wycliffe Golf and Country Club Homeowners’ Association, Inc. (each a “Member”) at one or
more of the charities supported by grants from the Foundation (individually and together
referred to as the “Charities”).
Independent Entity: Member understands and agrees that the Foundation is an entity
independent from Wycliffe Golf and Country Club Homeowners’ Association, Inc. (the
“Association”) and each of the Districts within the property of the Association (the “Districts”)
and that neither the Association nor the Districts exercise control or authority over, or manage,
the Foundation.
Release and Waiver: Member hereby freely, voluntarily, and without duress, agrees to the
following release and waiver of liability (the “Release”): Member hereby releases and forever
discharges and holds harmless the Foundation and its directors, officers, members, committee
volunteers and contributors, and its and their agents, successors, and assigns (each and
together, the “Releasees”), from any and all liabilities, claims, and demands of any kind or
nature, either in law or in equity, which arise, or may hereafter arise, from Member’s
participation in the Undertaking or from Activities at the Charities, or on account of any first
aid, treatment or service rendered in connection with a medical emergency during Member’s
engagement in Activities.
Member understands and agrees that this Release discharges the Releasees from any liability,
or claim, therefore, that Member may have against the Releasees with respect to bodily injury,
personal injury, illness, death, or property damage, whether caused by the negligence of
Releasees or otherwise, may result in connection with or from Activities at the Charities.
Limited Undertaking: Member understands and agrees that the Undertaking is limited to
providing the Member with an opportunity to volunteer at Charities, and that the Foundation is not
responsible to assess or evaluate in any way: (1) the scheduling, location or description of
Activities; (2) the environment in which Activities take place; or (3) the type, nature or duration
of the Activities or their appropriateness to the Member. Transportation to and from Activities
is solely the responsibility of the Member.
Insurance and Compensation: Member understands and agrees that the Foundation does not
assume any responsibility for or obligation to provide the Member with financial or other
assistance, including but not limited to, medical, health or disability benefits or insurance or for
compensation for volunteer services of any kind in connection with the Undertaking, the
Activities or otherwise.
Assumption of Risk: Member understands and agrees that the Activities may include work that
is hazardous to the Member. Member hereby expressly and specifically assumes the risk of injury or
harm in connection with or from the Activities or from transportation to or from Activities and
hereby releases and discharges the Releasees from all liability, and claims therefor, for bodily
injury, personal injury, illness, death, or property damage, in connection with or from the
Activities or such transportation.
Photographic Release: Member hereby grants and conveys to the Foundation all right, title,
and interests in any and all photographs, images, video, or audio recordings of Member or
Member’s likeness or voice made by, or on behalf of, the Foundation in connection with the
Activities.
Miscellaneous: Member hereby expressly agrees that this Release is intended to be as broad
and inclusive as permitted by the laws of the State of Florida, and that this Release shall be
governed and interpreted by the laws of the State of Florida. Member agrees that if any clause
or provision of this Release shall be held to be invalid by any court of competent jurisdiction,
the validity of such clause of provision shall not otherwise affect the remaining provisions of
this Release, which shall continue to be enforceable.
